About this document

Use this form when you have children under the age of 16 or between 16 and 18 and in full-time education or training and you are issuing divorce proceedings.

Where you have dependent children you must send this form to the court at the same time that you file the divorce petition. Where children are involved, the court treats their welfare as number one. By sending this form when issuing your divorce petition, the court can satisfy itself that the welfare of the children will be taken into account in the divorce process.

The form is uncomplicated and asks for details of the children, their schooling, with whom they live, whether they have any disabilities or special needs and so on. It also requires you to enter information about details of arrangements for the future - with whom the child will live, arrangements for future contact with the absent parent, any maintenance arrangements and so on.

If you are the petitioner, it is a good idea to get your soon-to-be-ex partner to sign the form before you file the divorce. By doing so, you show the court that you both agree with the panned arrangements. This will save time.

Sometimes it is not possible to obtain the respondent's signature to the form before filing the divorce petition (because, for instance, the parties are not on speaking terms). It is therefore more likely that the court will be called upon to make orders in relation to the children.

This form is also suitable for the respondent. If you don’t agree with the statement of arrangements filed by the petitioner you can use this same form when you return your acknowledgement of service form.
