The Disability Discrimination Act 2005 (Commencement No 3) Order 2007

The Secretary of State for Education and Skills, in exercise of the powers conferred by section 20(3) of the Disability Discrimination Act 2005(1), makes the following Order:

1-	Citation and interpretation

	(1)	This Order may be cited as the Disability Discrimination Act 2005 (Commencement No 3) Order 2007.
	(2)	In this Order “the Act” means the Disability Discrimination Act 2005.

2-	Provisions coming into force on 11th June 2007

11th June 2007 is the day appointed for the coming into force of section 15 (general qualifications bodies) of the Act, so far as it inserts into the Disability Discrimination Act 1995(2)—

		(a)	sections 31AA, 31AD and 31AE, for the purpose only of exercising any power to make regulations; and
		(b)	section 31AF.

3-	Provisions coming into force on 1st September 2007

1st September 2007 is the day appointed for the coming into force of the following provisions of the Act—

		(a)	section 15 , so far as it is not already in force; and
		(b)	paragraphs 25, 37(3), (4)(b) and 5(b) and 50(4)(a) and (5) of Schedule 1 (minor and consequential amendments), and section 19(1) so far as it relates to those paragraphs.

EXPLANATORY NOTE

(This note is not part of the Order)


	This Order is the third Commencement Order to be made under the Disability Discrimination Act 2005 (“the Act”). The Act extensively amends the Disability Discrimination Act 1995 (“the 1995 Act”).

	Article 2 commences sections 31AA, 31AD and 31AE of the 1995 Act, which are inserted by section 15 of the Act, on 11th June 2007 for the purpose only of exercising any power to make regulations, and commences section 31AF on that date for all purposes.

	Article 3 commences the following provisions of the Act on 1st September 2007:

	Chapter 2A of Part 4 of the 1995 Act, which is inserted by section 15 of the Act, so far as it is not already in force, and paragraphs 25, 37(3), (4)(b) and 5(b) and 50(4)(a) and (5) of Schedule 1 to the Act.

NOTE AS TO EARLIER COMMENCEMENT ORDERS

The provisions of the Disability Discrimination Act 2005 listed in the table below have been brought into force by Commencement Orders made before the date of this Order. The following provisions are commenced in relation to England only: section 9, Part 2 of Schedule 1, the entries in Schedule 2 relating to the Road Traffic Regulation Act 1984, and the Traffic Management Act 2004, and section 19 so far as relating to those provisions and entries.
