The Environmental Noise (England) (Amendment) Regulations 2008

  The Secretary of State is a Minister designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to measures relating to the assessment, management and control of environmental noise. The Secretary of State makes these Regulations in exercise of the powers conferred by that section.
1- Citation, commencement, extent and application
  These Regulations—
    (a) may be cited as the Environmental Noise (England) (Amendment) Regulations 2008;
    (b) come into force on 6th April 2008; and
    (c) apply in England.
2- Amendment of the Environmental Noise (England) Regulations 2006
  The Environmental Noise (England) Regulations 2006(3) are amended as follows.
3- In regulation 19 (duty to draw up, review and revise action plans), for “April”, in each place, substitute “June”.
    (a) In Schedule 2 (assessment methods for the noise indicators)—
    (b) in paragraph 2, for “LA10,18h” substitute “LA10,18h”;
    (c) in paragraph 3(a), for “Calculation of railway noise”, substitute “Calculation of Railway Noise 1995”;
    (d) in paragraph 3(b), for “railway noise”, substitute “Railway Noise”.

EXPLANATORY NOTE
(This note is not part of the Regulations)
 
  These Regulations amend the Environmental Noise (England) Regulations 2006 (S.I. 2006/2238).
  Regulation 3 amends regulation 19 so that the date by which airport operators must submit their action plans to the Secretary of State is extended to 30th June in 2008 and 2013.
  Regulation 4 corrects certain typographical errors in Schedule 2.
  A full impact assessment has not been produced for this instrument as no impact on the public, private or voluntary sectors is foreseen.
