This is a contractual tenancy agreement, sometimes differentiated from an assured shorthold tenancy agreement as a “non-assured” tenancy agreement. It forms a contract to let a residential property to a company: the company pays the rent and one or more employees (or perhaps an employee and his or her family) lives in the property. It includes provisions for how residents should care for furnishings and also for an inventory.

Letting to companies falls outside the Housing Acts, and so an assured shorthold tenancy agreement is not suitable. Companies also usually insist on different terms. Paying rent in a single instalment upfront, or on a quarterly or annual basis may be more convenient for the accounts department and may be beneficial for tax reasons. You may wish to include “business break clauses” to allow the company to move the employee at short notice, in a beneficial manner to the landlord.

The agreement is not suitable for terms greater than seven years (after which the law requires the property is registered with the Land Registry). Commonly, the term of a company let is much less, for example 1 to 3 years, and a new agreement with between the same parties is made once the old one expires.

Nor is it suitable for a letting where business will be carried out on the property (e.g. employees will work full time from the property). In these circumstances, a business lease would be required.

Tenant deposit protection schemes are not a requirement when letting to a company. As a landlord, you won’t need to register the deposit with one of these schemes.
