The Immigration, Asylum and Nationality Act 2006 (Commencement No. 7) Order 2007

  The Secretary of State makes the following Order in exercise of the powers conferred by section 62 of the Immigration, Asylum and Nationality Act 2006(1).
1- Citation and interpretation
  (1) This Order may be cited at the Immigration, Asylum and Nationality Act 2006 (Commencement No. 7) Order 2007.
  (2) In this Order “the 2006 Act” means the Immigration, Asylum and Nationality Act 2006.
2- Commencement
  The following provisions of the 2006 Act shall come into force on 5th November 2007—
    (a) section 15 (penalty for employment of adult subject to immigration control) for the purposes of making an order under subsections (2), (3) and (7);
    (b) section 16 (objection to penalty for employment of adult subject to immigration control) for the purposes of making an order under subsections (3) and (5);
    (c) sections 20 (orders) and 25 (interpretation);
    (d) section 31 (provision of information to immigration officers) for the purposes of making an order under paragraphs 27(2) and 27B of Schedule 2 to the Immigration Act 1971(2) as amended by that provision;
    (e) section 32 (passenger and crew information: police powers)(3) for the purposes of making an order under subsection (5)(a);
    (f) section 36 (duty to share information)(4) for the purposes of making an order under subsection (4);
    (g) section 37 (information sharing: code of practice) for the purposes of laying a draft code before Parliament and making an order under subsection (2);
    (h) section 38 (disclosure of information for security purposes)(5) for the purposes of making an order under subsection (4); and
    (i) section 50(4) and (5) (amendment to nationality and immigration procedure).
3- The following provisions of the 2006 Act shall come into force on 31st December 2007—
    (a) sections 34 (offence: failure to provide information), 35 (power of Revenue and Customs to obtain information) and 39 (disclosure to law enforcement agencies);
    (b) sections 31, 32, 36, 37 and 38 to the extent to which they are not already in force; and
    (c) in Schedule 3 (repeals) the entry relating to section 27 of the Immigration Act 1971 (offences by persons connected with ships or aircraft or with ports).

EXPLANATORY NOTE
(This note is not part of the Order)
 
  This Order brings into force provisions of the Immigration, Asylum and Nationality Act 2006. The provisions specified in article 2 are brought into force on 5th November 2007 (in some cases for the purposes of making secondary legislation only) and those specified in article 3 are brought into force on 31st December 2007.
