The Secretary of State for Work and Pensions makes the following Order in exercise of the powers conferred by paragraph 4(5) of Schedule 7 to the Social Security Contributions and Benefits Act 1992(1).
This Order may be cited as the Social Security (Industrial Injuries) (Dependency) (Permitted Earnings Limits) Order 2008 and shall come into force on 9th April 2008.

Increase in earnings limits in respect of dependent children and qualifying young persons
In paragraph 4(4) of Schedule 7(2) to the Social Security Contributions and Benefits Act 1992—
(a)
in paragraph (a), for “£180” substitute “£185”; and
(b)
in paragraph (b), for “£24” substitute “£25” and for “£180” substitute “£185”.

Where a disablement pension with unemployability supplement is increased in respect of one or more children or qualifying young persons and the beneficiary is one of two persons who are spouses or civil partners residing together or who are living together as husband and wife or civil partners, paragraph 4(4) of Schedule 7 to the Social Security Contributions and Benefits Act 1992 provides that the increase shall not be payable in respect of the first child or qualifying young person if the other person’s earnings are £180 a week or more and in respect of further children or qualifying young persons for each complete £24 by which the earnings exceed £180. This Order increases the amounts of £180 and £24 to £185 and £25 respectively.
A full impact assessment has not been produced for this instrument as it has no impact on the costs of business, charities or voluntary bodies.
