A road traffic accident is treated in law in just the same way as any other type of accident. The injured party must establish that the accident is someone else's fault, or at least partly someone else's fault. Liability is often difficult to prove unless you are the victim of a straight forward rear end collision. Generally, accidents on roundabouts are counted as 50:50. Accidents at traffic lights often need the services of a witness as, do lane-change accidents. Insurance companies - who are usually the ones to pay - set strict criteria which many Claimants describe as "wriggling". Unless the other side admit liability (in front of a witness or in writing as they can change their mind later) the issue of liability can be arguable. Use this letter to help your witness agree to provide information. It could be the way to get you the compensation you deserve. |
