We just want to check quickly that a tenancy agreement is appropriate for your situation. Most of the time it is, but there are a few situations where a different type of agreement is either required in law, or simply better at protecting the landlord´s rights.

Do any of the following apply to your situation?

1.	The tenant will run a business from the property. What you should do… You will probably need a business lease with special provisions for the tenant to live in the property. Net Lawman has a wide range of business leases that we can adapt very quickly for you. Contact us for further advice.
2.	You are renting space in your home, and you will live there as well. What you should do… You need a lodger agreement (also called a residential license). Look at Lodger agreement: license to rent a room.
3.	You are offering a house share arrangement. The tenant will rent a room and share common space (such as a kitchen or a bathroom) with other tenants who have similar, separate agreements. What you should do… A residential license agreement will be more suitable. Look at: Student tenancy agreement: license to rent a room. Although it covers a typical student house share arrangement, it can be used for non-students as well.
4.	The property has more than 2 acres of agricultural land, or is part of an agricultural holding. What you should do… Depending on the exact circumstances, you´ll need either a business lease or an agricultural lease. Net Lawman has a wide range of both types that we can adapt quickly for you. 5.	You are letting the property as holiday accommodation. What you should do… A holiday house agreement is more suitable. Look at Holiday house letting agreement or the other documents in the Holiday accommodation section.
6.	Your tenants are asylum seekers or foreign nationals with temporary protection. What you should do… This is a really difficult area and unfortunately we can´t draft a document for you. You should seek specialist advice from your solicitor.
7.	Annual rent is less than £250 (or £1,000 in Greater London). What you should do… Tenants have much greater rights if the rent is below these thresholds. If you can, find a way of agreeing a rent above the threshold and continue using this service. If you must have a low rent, then seek legal advice from your solicitor.
