The Mental Health Act 2007 (Commencement No. 1) Order 2007

  The Secretary of State, in exercise of the power conferred upon him by section 56(1) of the Mental Health Act 2007(1) hereby makes the following Order:—
1- Citation and extent
  (1) This Order may be cited as the Mental Health Act 2007 (Commencement No.1) Order 2007.
  (2) This Order extends to England and Wales.
2- Commencement
  Section 45 of the Mental Health Act 2007(2) comes into force on 24th July 2007.

EXPLANATORY NOTE
(This note is not part of the Order)
 
  This Order is the first commencement Order made under the Mental Health Act 2007 and brings into force section 45 of that Act in relation to England and Wales. Section 45 amends section 23 of the Mental Health Act 1983 (c.20) in relation to the delegation by National Health Service foundation trusts of their power to discharge patients from compulsion under the Act.
