About this document

This pack contains the forms required in order to effect a surrender of a business lease.

It can either be used as is, or can be used in conjunction with our pack to exclude security of tenure. The latter includes everything you will need in order to set up a lease which excludes security of tenure under the 2004 regulations. More information can be found here.

Before 2004, there were no special requirements for a surrender, so that a very simple agreement under hand was all that was required. The newer system provides for more formality and explanation, so as to protect the tenant and make quite clear that he understands the impact of the documents.

It is not necessary as a matter of law for the old lease to be terminated or surrendered, for a new lease to take effect, but is a preferred course of action so as to:

  • Make clear as between the parties that all obligations under the old lease have been satisfied

  • Provide evidence if required to third parties (such as Customs and Excise and the Inland revenue) that the lease has terminated

  • Avoid any problem arising by inadvertently agreeing the new lease in different terms, for example with slightly changed areas or boundaries
